Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Fourcense Technologies, a company registered in Kenya ("Company," "we," "our," or "us"), governing your access to and use of JuriBase AI ("Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility and Accounts
1.1 The Service is available to all individuals and entities. By using the Service, you represent that you have the legal capacity to enter into these Terms.
1.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
1.3 Account sharing is not prohibited; however, usage is subject to applicable limits, which may be adjusted at our discretion.
2. Nature of the Service
2.1 The Service provides AI-powered tools for legal research, including semantic search of case law and related features.
2.2 The Service does not provide legal advice. Outputs generated by the Service are intended for informational and research purposes only. You remain solely responsible for verifying all results and exercising independent professional judgment.
3. Plans, Pricing, and Modifications
3.1 We may offer free or paid subscription plans with varying features and usage limits.
3.2 We reserve the right to change our pricing, limits, and features. We will provide active subscribers with at least 30 days prior notice of any material changes to pricing or features that adversely affect them. The free tier may be modified or withdrawn at our discretion.
3.3 Continued use of the Service after such changes take effect will constitute your acceptance of the changes. If you do not agree to the new terms, you may cancel your subscription before the new terms become effective.
4. User Obligations
4.1 You agree not to misuse the Service, including but not limited to:
- Attempting to hack, disrupt, or compromise the Service.
- Using the Service for unlawful purposes.
- Scraping, reverse engineering, or attempting to circumvent access controls.
4.2 You remain solely responsible for your use of the Service and any consequences arising therefrom.
5. Data and Privacy
5.1 Our collection and use of your personal information, including data generated through your use of the Service, are governed by our Privacy Policy.
5.2 We retain your data only for as long as necessary, in compliance with applicable data protection laws. Data may be aggregated or anonymized to improve the Service, provided it does not identify any individual.
5.3 We do not currently support uploading of user documents; however, if such functionality is introduced, the handling of such data will be subject to our Privacy Policy.
6. Intellectual Property
6.1 Company Ownership: The Service, including its underlying technology, software, algorithms, and design, are the exclusive property of Fourcense Technologies and its licensors.
6.2 User Content & Outputs: You retain all rights to any original queries you input into the Service. To the extent permitted by law, you own the specific outputs generated by the Service in response to your queries. However, you acknowledge that AI-generated outputs may not be unique and other users may receive similar outputs.
7. Disclaimers
7.1 The Service is provided on an "as is" and "as available" basis without warranties of any kind.
7.2 We make no representation or warranty as to the accuracy, completeness, reliability, or suitability of results provided by the Service.
7.3 The Service is not a substitute for legal advice, and reliance on its output is at your sole risk.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, our total liability arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim. This limitation does not apply to liability resulting from our gross negligence, willful misconduct, or fraud.
8.2 We shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.
9. Suspension and Termination
9.1 We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or engaged in malicious or unlawful use.
9.2 If we terminate your account for cause (e.g., you significantly violate these Terms, hack the Service, or use it for illegal purposes), you will not be entitled to any refund for prepaid or unused fees.
9.3 If we terminate your account or discontinue the Service for our convenience (without cause), you will be entitled to a pro-rated refund of any prepaid fees for the remaining term of your subscription.
10. Governing Law and Dispute Resolution
10.1 These Terms shall be governed by and construed in accordance with the laws of Kenya.
10.2 Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
10.3 Notwithstanding the foregoing, we may seek injunctive or equitable relief in any jurisdiction to protect our intellectual property or prevent misuse of the Service.
11. General Provisions
11.1 These Terms constitute the entire agreement between you and us with respect to the Service.
11.2 If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
11.3 Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
